1. Acceptance of terms

By accessing the website or placing any order (online, by phone, or by mail), you agree to be bound by these Terms and Conditions. These Terms are binding upon order confirmation. If you do not agree, please do not use our services.

3. Products and pricing — Colorado Honest Pricing Law compliance

In compliance with Colorado's Honest Pricing Law (C.R.S. § 6-1-738, effective January 1, 2026), all product prices displayed on our website and in any advertising represent the total price the consumer will pay, exclusive of applicable sales tax. No hidden fees, surcharges, or additional charges will be applied after the displayed price, except:

(a) Applicable Colorado sales tax; and
(b) The Colorado Retail Delivery Fee, if and when it applies to your order (see Section 4).

In the event of a pricing error, Leah's All Occasion Baskets, LLC reserves the right to cancel the affected order and issue a full refund. Customers will be promptly notified of any such error.

4. Colorado Retail Delivery Fee

Colorado charges a retail delivery fee on deliveries made by motor vehicle to a Colorado address (HB21-1312). Colorado law exempts small retailers, those whose retail sales in Colorado in the previous calendar year were $500,000 or less, from collecting and remitting this fee. Leah's All Occasion Baskets, LLC currently qualifies for that exemption, so no retail delivery fee is added to your order. If the business ceases to qualify, the fee will be shown as a separate line item on your order summary and order confirmation before you complete your purchase.

5. Ordering — FTC Mail and Telephone Order Rule compliance

Orders may be placed via our website, by telephone, or by mail. Pursuant to the Federal Trade Commission Mail or Telephone Order Merchandise Rule (16 C.F.R. Part 435):

(a) Orders will be shipped within the timeframe stated at the time of purchase, or within thirty (30) days if no timeframe is specified.
(b) If we are unable to ship within the stated or implied timeframe, we will notify you via email or phone with a revised shipment date and offer you the option to: (i) consent to the delay and await shipment, or (ii) cancel the order for a full refund.
(c) If you do not respond to a delay notice within the time specified in the notice, the order will be treated as cancelled and a full refund will be issued within seven (7) business days.
(d) You may cancel any unshipped order at any time by contacting us at info@leahsalloccasionbaskets.com or (719) 280-2341.

6. Cottage Foods Act notice (Colorado)

Some products sold by Leah's All Occasion Baskets, LLC may be produced in a home kitchen under Colorado's Cottage Foods Act (C.R.S. § 25-4-1614 et seq.). These products are not inspected by the Colorado Department of Public Health and Environment. Any such product will bear the following required label disclosure:

“MADE IN A HOME KITCHEN NOT INSPECTED BY THE COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT.”

Cottage food products may only be sold directly to the end consumer. Customers with known food allergies or sensitivities are strongly encouraged to inquire prior to purchase by contacting info@leahsalloccasionbaskets.com or (719) 280-2341.

7. Payment

All transactions are processed securely through a third-party payment processor. Leah's All Occasion Baskets, LLC does not store full credit card or payment account information. Sales tax will be collected in accordance with applicable Colorado law. Accepted payment methods are displayed at checkout.

8. Shipping and delivery

Delivery timeframes are estimates only and are not guaranteed unless expressly confirmed in writing. Risk of loss or damage transfers to the customer upon delivery to the carrier. Leah's All Occasion Baskets, LLC is not responsible for delays caused by carriers, weather events, natural disasters, or other circumstances outside our reasonable control. Where product availability requires a substitution, items of equal or greater value will be substituted with prior notice to the customer where reasonably practicable.

9. Cancellations

Standard orders may be cancelled before shipment at no charge. Custom or personalized orders may not be cancellable once production has begun. To cancel an order, contact us promptly at info@leahsalloccasionbaskets.com or (719) 280-2341. See our Refund Policy for full details.

10. Intellectual property

All website content, including but not limited to images, logos, text, product descriptions, and graphic elements, is the exclusive property of Leah's All Occasion Baskets, LLC and is protected by applicable copyright and trademark law. No content may be reproduced, distributed, or used without prior written permission from Leah's All Occasion Baskets, LLC.

11. Limitation of liability

To the maximum extent permitted by applicable law, Leah's All Occasion Baskets, LLC's total liability for any claim arising from a purchase is limited to the purchase price of the goods at issue. Leah's All Occasion Baskets, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Customers are encouraged to inspect all items upon receipt and report any concerns within three (3) business days of delivery.

12. Allergen and food safety disclaimer

Gift baskets and food products may contain or have been produced in proximity to common allergens including, but not limited to, tree nuts, peanuts, dairy, gluten, eggs, and soy. Customers must disclose all known allergies and dietary restrictions at the time of order. Leah's All Occasion Baskets, LLC is not liable for allergic reactions or adverse food responses when allergen information was not disclosed prior to purchase.

13. Governing law and dispute resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any dispute arising from or related to these Terms or any purchase shall be subject to a mandatory thirty (30) day informal resolution period before formal legal proceedings may be initiated. Unresolved disputes shall be submitted to binding arbitration or litigated in the state courts of Colorado, at the election of Leah's All Occasion Baskets, LLC.

14. Data sharing

Customer data is not shared with 3rd parties for promotional or marketing purposes.
Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.

Leah's All Occasion Baskets LLC messaging terms and conditions

The messaging program consists of general conversational messaging to answer questions and provide support to customers.
You can cancel the SMS service at any time. Just text ‘STOP’ to the phone number from which you received messages. After you send the SMS message ‘STOP’ to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

15. Changes to these terms

Leah's All Occasion Baskets, LLC reserves the right to update or modify these Terms at any time. Updated Terms will be posted to our website with a revised effective date. Continued use of our website or services following any update constitutes your acceptance of the revised Terms.
